THE ROLE OF CUSTOMARY LAW IN SUSTAINABLE INFRASTRUCTURE DEVELOPMENT IN SOUTH SULAWESI

Abstract


Pembangunan infrastruktur bukanlah hal yang mudah untuk dilaksanakan. Karena keragaman budaya dan kondisi geografis, sehingga dalam pelaksanaannya harus sesuai dengan nilai-nilai masyarakat adat. Penelitian ini bertujuan untuk menganalisis ketentuan pemanfaatan sumber daya alam masyarakat adat dan menganalisis implementasi hukum adat dalam pembangunan infrastruktur berkelanjutan. Penelitian ini menggunakan metode pendekatan yuridis normatif melalui bahan kajian hukum primer dan sekunder untuk mencari jawaban atas penelitian tersebut. Hasil penelitian menunjukkan bahwa pembangunan infrastruktur yang menjadi hak adat masyarakat adat untuk kepentingan umum dapat dilakukan dengan penyerahan tanah oleh pemerintah bersama masyarakat adat berdasarkan kesepakatan antar masyarakat adat dan peraturan yang berlaku. Dalam pembangunan infrastruktur suatu kawasan memerlukan sumber daya alam baik berupa tanah maupun hutan, tentunya dalam pelaksanaan pembangunan infrastruktur terkadang masuk ke dalam kawasan hutan adat dan tanah adat sehingga menimbulkan konflik yang semakin tajam, apalagi masyarakat adat telah menerima hak negara atau hak milik. pengakuan pemerintah daerah yang dituangkan dalam Peraturan Daerah.
